Abstract

The chacreamentos are considered a form of reconfiguration of rural land occupation, causing the proliferation of small rural plots, generally sold for recreation, leisure and/or housing purposes. This study aimed to discuss the legal aspects of the institute of chacreamento as a practice of subdivision of rural land, considering respect for the social function of the property. This is a qualitative and descriptive research, carried out from A bibliographical and documentary review. It was observed that the chacreamento presents a legal imbroglio in relation to the fractioning of rural areas below the Minimum Fraction of Parceling. It is expected to awaken people’s science and awareness that, despite the (in)feasibility of subdivision of rural land, its current practice must be based on transparency, legality and, above all, with a focus on environmental preservation.
