This article has the scope to analyze the constitutional principle of the freedom of education from the point of view of the Federal Constitution of 1988. First, an approach is made on the right to education, the cradle of the right to freedom of education, which aims to promote Citizenship, humanization, the appreciation of access to knowledge, access and permanence in school and quality education, with the purpose of training critical and conscious subjects capable of acting in society. Subsequently, it will investigate the right to freedom of teaching in its conceptual aspect, in addition to the justification for applying this right in teaching activity, joining it to the right to pluralism of ideas.
