THE RIGHT TO EDUCATION AND THE WIDENING OF ACCESS TO MIDDLE SCHOOL: AN ANALYSIS OF THE PROPOSITIONS OF THE FEDERAL LEGISLATIVE BRANCH (1996-2016)

Abstract

This article provides an investigation of how the widening of the right to education, particularly the High School, has been treated by the Federal Legislative Branch in Brazil after the Law 9394/96 was sanctioned. Considering the constitutional devices related to the duties of the State regarding to the education, the research analyzed the propositions (law projects and others) dealing with supplementary powers that enable the access to permanence in and conclusion of the last stage of Basic Education: didactic materials, transportation, feeding and healthcare. The analysis of the propositions indicates limits in the legislative activity that compromise the democratization of the school and the establishment of High School as Basic Education, as determined by the Brazilian Law of Guidelines and Bases of Education.
