THE CHALLENGES OF BRAZIL TO DEAL WITH THE INTERNATIONAL ILLEGAL TRADE OF WASTE AND RESIDUES

Abstract

Because of the growth of international movements of waste and residues, countries face environmental challenges and risks related to deal with such trade. The objective of the study was to verify the origin, type of waste and the penalties imposed on those responsible for the importation of toxic waste to Brazil as if they were legal goods. This was a qualitative, theoretical and critical, bibliographical and documentary study, based mainly to the Basel Convention. As Brazil is a signatory to the Basel Convention and that prohibits the marketing of toxic waste, foreign exporters and Brazilian importers seek ways to circumvent the law and camouflage the exported goods, trying to fit it into any of the statutory categories of goods accepted by the Convention. It was concluded that the challenges are related to improved monitoring the ilegal trade because not only foreigners, but also Brazilians try to circumvent the law of Basel for their own benefit and drive the illegal trade in toxic waste in Brazil, despite the harmful consequences for the country.
