Abstract

 CONTEXT: It is part of the institutional context of the law and literature movement. Provides a reading on the loan agreement summarized in topic 4.

OBJECTIVE: Explain the use of law and literature in contract law, especially in relation to loan, fees and loan sharking.

METHOD: Based on the methodology of law in literature, it examines the notions of loan, loan sharking and fees in the short story “The Loan”, by Machado de Assis.

RELEVANCE/ORIGINALITY: The relevance of the debate is to remove law from dogmatic confinement through an approach to law in literature.

RESULTS: It shows the problem of legal exclusivism and suggests the possibility of apprehending the law through the literature.

THEORETICAL/ METHODOLOGICAL CONTRIBUTIONS: What is intended with the article is a greater opening of legal dogmatics to interdisciplinary collaboration.
