“Judicialyzing” education´s quality
the unconstitutionality of the educational system of continued progression

A proposta de analisar o modelo da progressão continuada sob a ótica constitucional revela-se de grande utilidade para uma compreensão mais profunda do fenômeno da judicialização da qualidade do ensino, conferindo-lhe um novo enfoque, que prioriza o questionamento acerca da natureza do próprio Direito à Educação. O presente estudo busca, ao atentar para a necessária reaproximação entre a Lei nº 9.394/96 e a Constituição, compreender o impacto das revelações trazidas pelos princípios constitucionais para o sistema da progressão continuada, questão aqui escolhida para debate por representar, indubitavelmente, um dos grandes desafios do Direito à Educação na contemporaneidade.
