Abstract

Analyzes the international legal order of human rights, particularly at the inter-American level, to see the possibility of filing with the Inter-American Commission on Human Rights a complaint of unwarranted delay in the criminalization of LGBTIphobia on the part of the Brazilian State, since the Brazil is a signatory of several international treaties and agreements that oblige it to legislate and curb forms of LGBTIphobia in national territory. Moreover, the Constitution of the Republic of 1988 that inaugurates the Democratic State of Right advocates for the fundamental Right of Equality and non-discrimination on the part of the State. For this it is assumed that Brazil is in default that violates the Constitution and International Human Rights Norms, which provoked the filing of ADO. n. 26 and MI. n. 4733, both asking the STF to recognize the unconstitutional omission of Brazil in this regard. Both actions began the trial in February 2019 and, for the time being, they had four favorable votes. The methodology used in the work is legal-sociological.
