Interpretação do artigo 139, IV, do CPC no modelo constitucional de processo

O artigo trata das controvérsias em torno da interpretação do artigo 139, IV, do CPC sob a perspectiva do modelo constitucional de processo. Busca-se verificar se a redação do novo dispositivo legal autoriza que medidas coercitivas sejam criadas de modo discricionário pelos órgãos jurisdicionais, ancorados em princípios de proporcionalidade e razoabilidade e, em caso afirmativo, se essa é uma leitura adequada considerando os fundamentos do Estado Democrático de Direito.
