Republicanismo, Liberalismo e Direito

O Republicanismo é geralmente contrastado com o Liberalismo como duas ideias centrais e opostas do pensamento jurídico e constitucional moderno. Ambas as teorias jurídico-políticas atraem novos significados, em busca de vários objetivos jurídicos e políticos. É comum que juristas distinguam o Liberalismo, como aquele que considera direito como o mal necessário; e Republicanismo como sendo auto expressão cultural através do direito. Mas tal leitura é equivocada e ignora as origens históricas e o melhor uso de ambos os termos. O presente texto tem por objetivo lançar um olhar mais atento às origens e as doutrinas fundamentais do Republicanismo e do Liberalismo, revelando que os seus princípios não são necessariamente conflitantes; e que cada uma defende o direito como o instrumento necessário de justiça social.
