O novo CPC como instrumento legal da democratização do processo

Não há razões para se atribuir apenas ao juiz, e não aos demais sujeitos processuais, a responsabilidade pela construção da teoria que, do ponto de vista democrático, melhor resolva o caso judicializado. No âmbito dos tribunais, todos têm – em especial, os destinatários do provimento jurisdicional - de argumentar em favor de direitos e, portanto, principiologicamente. A legitimidade democrática do processo tem no Novo CPC, fruto da política legislativa, sua condição legal e normativa de possibilidade.
