This article aimed to analyze the process of concession of public use services in the protected areas of the State of São Paulo, from the perspective of participatory planning. The historical survey of the theme was carried out, as well as documents of the process that culminated in the sanctioning of Law No. 16.260 of June 29, 2016, the follow-up of the steps that preceded the bidding for services in the CantareiraState Park (CSP). It was found that the theme has been legislated in the state since the 1960s, but has been inert in recent decades and has been resumed on the political agenda recently. The enactment of the Law and participatory rites, despite their official occurrence, neglected to deepen the debate and incorporate different interests. Public hearings and advisory board meetings proved to be mere spaces for exposition and legitimation of the previously conceived project. The need for reflection and modernization of participatory spaces was contacted in order to genuinely incorporate the demands of civil society, as well as the deepening of studies on alternative models of partnerships with private entities and / or Society organized civil society.
