De como a sentença não pode constituir um “grau zero” de sentido na judicialização do direito à saúde

O presente artigo visa investigar a legitimidade da técnica da ponderação de interesses para fundamentar decisões judiciais sobre o direito à saúde. Isto é, busca-se encontrar critérios de decisão que fujam do subjetivismo e da discricionariedade dos magistrados, propugnando-se pela resposta hermenêutica e constitucionalmente correta. O que se defende no artigo é que a justiça não deve ficar condicionada ao fator “sorte”, de acordo com o magistrado que for julgar a causa, em especial quando o assunto é o direito à saúde. Com base nos estudos filosóficos de Heidegger e Gadamer, bem como nas diversas teorias de Dworkin, conclui-se que a igualdade na alocação de recursos deve ser vista como a “virtude soberana” na tutela da saúde.
