A competência constitucional para legislar sobre processo e procedimentos e o Código de Processo Civil de 2015

O presente trabalho pretende analisar uma novidade introduzida pela Constituição de 1988: a competência da União, dos Estados e do Distrito Federal para legislar sobre processo e procedimento. Para tanto, são analisadas as três espécies de competência legislativa e seus limites, bem como os conceitos, semelhanças e distinções entre processo e procedimento, a fim de tentar estabelecer as competências dos entes públicos. A partir de tais premissas e considerando-se as garantias fundamentais do processo justo, tenta-se demonstrar que é possível a adequação de tais competências na perspectiva do novo Código de Processo Civil, observada a segurança jurídica e a celeridade.
