FUNÇÃO SOCIAL DA EMPRESA E ECONOMIA COLABORATIVA: ANÁLISE DA RESPONSABILIDADE CIVIL NESTA FORMA DE CONTRATAR

O presente artigo objetiva analisar o contexto histórico em que se deu o surgimento da função social da empresa, bem como o surgimento de uma nova forma de contratar que atendesse aos anseios de uma sociedade preocupada não apenas com o consumo, mas também com as consequências dele. Pretende-se explicar como se dá o consumo colaborativo e investigar de que forma as pessoas envolvidas no fornecimento de bens e serviços compartilhados podem ser responsabilizadas, se pela normativa do Código de Defesa do Consumidor ou através do Código Civil. Para o desenvolvimento do presente lançou-se mão do método dedutivo com base em material bibliográfico, revistas impressas e eletrônicas, jurisprudência e legislação nacional.

ABSTRACT

The present article aims to analyze the historical context in which the company's social function emerged, as well as the emergence of a new way of hiring that would meet the aspirations of a society concerned not only with consumption but also with the consequences of it. It is intended to explain how the collaborative consumption occurs and to investigate how the people involved in the supply of shared goods and services can be held accountable, whether by the regulation of the Consumer Defense Code or through the Civil Code. For the development of the present, the deductive method was used based on bibliographical material, printed and electronic magazines, jurisprudence and national legislation.
