DISCRICIONARIEDADE ADMINISTRATIVA EM TEMPOS DE COVID-19, CONTROLE JUDICIAL E RESPONSABILIDADE DO AGENTE PÚBLICO

Objetivos: O estudo investiga os limites do controle judicial de atos administrativos que envolvem o complexo enfrentamento da pandemia da Covid-19. Buscam-se parâmetros que possam contribuir para análise das medidas sanitárias adequadas ao combate da epidemia. Examina-se ainda a responsabilização de agentes públicos por ação e omissão em atos relacionados com a pandemia da Covid-19, à luz da Medida Provisória n.º 966/2020.
Metodologia: A pesquisa utiliza o método dedutivo, a partir do exame de normas jurídicas, livros, artigos científicos e precedentes judiciais.
Resultados: O artigo demonstra que a sindicância judicial das medidas sanitárias em tempos de pandemia da Covid-19 deve pautar-se em subsídios científicos e/ou técnicos, cujo suporte pode advir, dentre outros meios, da produção de prova pericial e da admissibilidade do amicus curiae. Os resultados apontam que, em razão da incompreensão sobre quais os efeitos a atuação do agente público podem vir a produzir, é indispensável a rigorosa fundamentação das decisões e dos atos administrativos, como forma de se depreender os pressupostos fáticos e finalísticos que nortearam a escolha do agente público, de modo a permitir a perquirição do elemento subjetivo da conduta para fins de responsabilização civil e administrativa.
Contribuições: O estudo aborda temática atual e inovadora que merece maior discussão em âmbito acadêmico, sobretudo pela complexidade que acomete os conflitos causados pela pandemia da Covid-19. Por meio deste ensaio, objetiva-se aprimorar o controle de atos administrativos envolvendo o enfrentamento da pandemia e oferecer parâmetros teóricos que facilitem a identificação do elemento subjetivo na conduta do agente público para fins de responsabilização civil e administrativa em tempos de pandemia.

Objectives: The study investigates the limits of judicial control over administrative acts involving the complex confrontation of the Covid-19 pandemic. Parameters are sought that can contribute to the analysis of adequate sanitary measures to combat the epidemic. It also examines the accountability of public agents for actions and omissions in acts related to the Covid-19 pandemic, in the light of Provisional Measure No. 966/2020.

Methodology: The research uses the deductive method, from the examination of legal norms, books, scientific articles and court precedents.

Results: The article demonstrates that the judicial investigation of sanitary measures in times of Covid-19 pandemic must be based on scientific and / or technical subsidies, whose support may come, among other means, from the production of expert evidence and the admissibility of amicus curiae. The results show that, due to the misunderstanding of what effects the performance of the public agent may produce, it is essential to rigorously base the decisions and administrative acts, as a way to understand the factual and finalistic assumptions that guided the choice of the public agent, in order to allow the subjective element of conduct to be investigated for civil and administrative accountability.

Contributions: The study addresses a current and innovative theme that deserves further discussion in the academic field, especially because of the complexity that affects the conflicts caused by the Covid-19 pandemic. Through this essay, the objective is to improve the control of administrative acts involving the confrontation of the pandemic and to offer theoretical parameters that facilitate the identification of the subjective element in the conduct of the public agent for purposes of civil and administrative accountability in times of pandemic.
