DIREITO AO DESENVOLVIMENTO EM DISPUTA NA ERA NEOLIBERAL: CONTEÚDO, PROCESSUALIDADE E POLÍTICAS PÚBLICAS

Objetivo: O objetivo é reconstruir historicamente o conteúdo do direito ao desenvolvimento e evidenciar sua relação com a efetivação dos direitos humanos sociais, com a subsequente abordagem da sua dimensão processual, concretamente vislumbrada por meio da implementação de políticas públicas que observem, concomitantemente, em sua formulação e execução, os aspectos materiais desenvolvimento humano e os preceitos jurídicos contidos nas normas internacionais consagradoras do direito ao desenvolvimento sustentável.
Metodologia: Utiliza-se a metodologia dedutiva de abordagem e histórico-bibliográfica de procedimento.
Resultados: A hipótese apresentada é no sentido de que a dimensão processual do direito ao desenvolvimento sustentável tem na adequação das políticas públicas objeto de disputa antineoliberal pela efetivação do desenvolvimento, passível de ser apropriado pela sociedade civil, no espaço nacional, e por Estados não econômica e geopoliticamente hegemônicos, no espaço internacional.
Contribuição: O presente estudo, animado por uma perspectiva performativa, busca contribuir com as reflexões sobre o direito ao desenvolvimento em contexto neoliberal, posto como direito ao desenvolvimento sustentável em sentido amplo "” isto é, nos campos econômico, social, cultural e ambiental.

ABSTRACT
Objective: The aim of the article is to make the historical reconstruction of the content of the right to development and how it relates to the enforcement of social human rights and its procedural dimension, concretely envisioned through the implementation of public policies that simultaneously observe, in its formulation and execution, the material aspects of human development, as well as the existing legal precepts contained in the international standards that enshrine the right to sustainable development.
Methodology: In the analysis, the deductive methodology of approach and the historical-bibliographical procedure were used.
Results: The hypothesis presented is that the procedural dimension of the right to sustainable development uses the adequacy of public policies to create an object of dispute against neoliberalism that is capable of development effectiveness, which can be appropriated by civil society (nationally), and by states that are not economically and geopolitically hegemonic (internationally).
Contributions: The present study, based on a performative perspective, seeks to contribute to the perspectives on the right to development in a neoliberal context, considered as the right to sustainable development in a broad sense - that is, in the economic, social, cultural and environmental fields.
