A LEI GERAL DE PROTEÇÃO DE DADOS E OS REFLEXOS NO DIREITO DA PERSONALIDADE

Objetivos: O artigo tem como objetivo o estudo da evolução histórica dos direitos da personalidade, para então proceder à sua análise no ordenamento jurídico brasileiro, mediante a sua conceituação e características, sendo crucial também uma abordagem acerca dos direitos fundamentais, para, posteriormente estudar o atual estágio de sociabilidade humana denominado Sociedade da Informação e a imprescindibilidade da promulgação da Lei Geral de Proteção de Dados, uma vez que as novas tecnologias trazem novos desafios a respeito da tutela da pessoa humana. Assim, a aludida lei será analisada por intermédio dos seus objetivos e fundamentos, destacando-se, dentre eles, a proteção da privacidade, para, ao final, concluir que a proteção de dados pessoais deve ser considerada um novo direito da personalidade e não apenas uma mera extensão do direito à privacidade, tendo em vista que os dados têm o potencial de revelar diversos atributos de um indivíduo, assim como informações sensíveis ao seu respeito.
Metodologia: O método que será utilizado é o jurídico teórico e o raciocínio dedutivo.
Resultados: Assim, a aludida lei será analisada por intermédio dos seus objetivos e fundamentos, destacando-se, dentre eles, a proteção da privacidade, para, ao final, concluir que a proteção de dados pessoais deve ser considerada um novo direito da personalidade e não apenas uma mera extensão do direito à privacidade.
Contribuições: tendo em vista que os dados têm o potencial de revelar diversos atributos de um indivíduo, assim como informações sensíveis ao seu respeito.

ABSTRACT
Objectives: The article aims to study the historical evolution of personality rights, to then proceed with its analysis in the Brazilian legal system, through its conceptualization and characteristics, also being crucial an approach about fundamental rights, to subsequently study the current stage of human sociability called the Information Society and the indispensability of the enactment of the General Data Protection Law, since new technologies bring new challenges regarding the protection of the human person. Thus, the aforementioned law will be analyzed through its objectives and foundations, highlighting, among them, the protection of privacy, to, in the end, conclude that the protection of personal data must be considered a new right of the personality and not just a mere extension of the right to privacy, given that data has the potential to reveal various attributes of an individual, as well as sensitive information about them.
Methodology: The method that will be used is theoretical legal and deductive reasoning.
Results: Thus, the law will be analyzed through its objectives and foundations, highlighting, among them, the protection of privacy, to, in the end, conclude that the protection of personal data must be considered a new right of the personality and not just a mere extension of the right to privacy.
Contributions: considering that the data have the potential to reveal several attributes of an individual, as well as sensitive information about them.
