O BEM COMUM NA EMPRESA: CONTRIBUIÇÕES DA TEORIA NEOCLÁSSICA DA LEI NATURAL PARA A ÉTICA EMPRESARIAL

Objetivo: Este artigo tem por objetivo oferecer mais uma perspectiva ética para a compreensão das relações empresariais: a noção de bem comum, tal como explicada pela Teoria Neoclássica da Lei Natural. O problema da pesquisa pode ser formulado pela seguinte pergunta: como a perspectiva de bem comum contribuiria para compreender as relações empresariais e o mercado enquanto instituição humana?
Metodologia: A pesquisa é primariamente expositiva nas primeiras duas seções e dialética na terceira, quando o conceito de bem comum é aplicado à s relações empresariais.
Resultados: Esclarecimento acerca de como a perspectiva ética da ação humana influencia na compreensão do mercado, da economia e do papel do Estado na regulação. A noção de bem comum é capaz de articular a valorização social do trabalho e da livre iniciativa com os ditames da justiça social, conforme a Constituição Federal de 1988. Além disso, ainda consegue inserir o mercado "“ e a liberdade que lhe é necessária "“ como instituição apta a propiciar bens que são aspectos do florescimento humano. Essa instituição precisa atender aos requisitos de razoabilidade prática de tal maneira que as normas jurídicas elaboradas para ela têm necessariamente que contar com a liberdade que lhe é característica.
Contribuições: A justificativa desta pesquisa está na inserção de mais uma corrente ética no debate que trata da ética empresarial. Antes que um confronto de teses com outras perspectivas éticas, o objetivo é apresentar a condição de possibilidade para que semelhante debate acadêmico possa acontecer: a exposição de uma teoria. Além disso, autores como Manuel Velasquez (2017) e Carlos Llano Cifuentes (2011), ainda pouco estudados no Brasil, compõem parte do referencial teórico do artigo.

ABSTRACT
Objective: This article aims to offer another ethical perspective for understanding business relationships: the notion of common good, as explained by the Neoclassical Theory of Natural Law. The research problem can be formulated by the following question: how would the common good perspective contribute to understanding business relationships and the market as a human institution?
Methodology: The research is primarily expository in the first two sections and dialectical in the third, when the concept of common good is applied to business relationships.
Results: Clarification about how the ethical perspective of human action influences the understanding of the market, the economy and the role of the State in regulation. The notion of common good is able to articulate the social valuation of work and free enterprise with the dictates of social justice, according to the 1988 Federal Constitution. institution able to provide goods that are aspects of human flourishing. This institution needs to meet the requirements of practical reasonableness in such a way that the legal norms elaborated for it must necessarily have the freedom that is characteristic of it.
Contributions: The justification for this research lies in the insertion of another ethical current in the debate that deals with business ethics. Before a confrontation of theses with other ethical perspectives, the objective is to present the condition of possibility for a similar academic debate to take place: the exposition of a theory. In addition, authors such as Manuel Velasquez (2017) and Carlos Llano Cifuentes (2011), still little studied in Brazil, form part of the article's theoretical framework.
