PERDA DE UMA CHANCE NA SEARA MÉDICA: A TEORIA DAS PROBABILIDADES APLICADA À ARTE DA PROBABILIDADE

Objetivo: O presente estudo tem por objetivo propor reflexões acerca das limitações e controvérsias da aplicação da teoria jurídica da perda de uma chance à seara médica, enquadramento tido como marca do novo paradigma da responsabilidade civil. Para além dos elementos doutrinários, o artigo recorre ao fundamento científico epidemiológico com o propósito de apontar as problemáticas derivadas dessa aplicação. Sobretudo aquelas relacionadas ao aparente desalinho entre as bases da medicina "“ tida como a arte da probabilidade "“, do raciocínio clínico e os pressupostos da teoria.
Metodologia: Hipotético-dedutivo, com a utilização de técnica de pesquisa bibliográfica incluindo doutrina do direito civil e literatura médica em propedêutica médica e clínica médica.
Resultados: O universo médico e suas áleas, o progresso científico experimentado nesse campo e os instrumentos epidemiológicos disponíveis possuem limitações, em especial, no que se refere à mensuração de probabilidades diagnósticas e terapêuticas, o que dificulta a aplicação da teoria jurídica da perda de uma chance à seara médica. No contraponto, há contextos em que a harmonização da teoria com o exercício da medicina parece amoldar-se de forma mais apropriada, como nos casos de obrigação de resultados, frequentemente atribuíveis aos procedimentos estéticos.
Contribuição: O artigo contribui com o avanço do debate jurídico científico sobre o tema vez que salienta a importância do reconhecimento das características de fortuito e imponderável da ciência médica, reafirmando os entraves faceados para se traduzir em percentuais estatísticos as chances de cura, vida ou morte de pacientes, contexto que reflete, em alguma medida, nas dificuldades de aplicação da teoria da perda da chance a esse universo.

ABSTRACT
Objective:Â The present study aims to propose reflections on the limitations and controversies of the application of the legal theory of losing a chance to the medical field, a framework considered as a mark of the new paradigm of civil liability. In addition to the doctrinal elements, the article uses the epidemiological scientific basis, with the purpose of pointing out the problems derived from this application. Especially those related to the apparent mismatch between the foundations of medicine - regarded as the art of probability - of clinical reasoning and the assumptions of theory.
Methodology:Â Hypothetico-deductive method, using the technique of bibliographical research, including the civil law doctrine and medical literature about propaedeutic (workup) and clinic.
Results:Â The medical universe and its alleys, the scientific progress experimenting in that area, and the epidemiological tools available, all have limits, especially regarding the measure of diagnostic and therapeutic probabilities, making the application of the legal theory called "œloss of a chance" even more difficult to the medical field. On the other hand, there are contexts in which the harmonization of theory and medical practice seems to be shaping itself around in a more appropriate way, as in those cases of mandatory results, frequently chargeable to cosmetic procedures.
Contribution:Â This article adds to the legal scientific discussion on this topic, as it stresses the relevance of the recognition of fortuitous and imponderable characteristics of medical science, reassuring the obstacles that are faced to be translated into statistic percentage of chances of cure, life or death of patients, which reflects, to some extent, the difficulties of the "œloss of a chance" theory application to this universe.
