A ALTERIDADE COMO FUNDAMENTO ÉTICO DA JUSTIÇA RESTAURATIVA

Resumo

Objetivo: Este artigo, inserido no âmbito da filosofia de Emmanuel Lévinas e do Paradigma Restaurativo na esfera do Direito Penal contemporâneo, busca circunscrever e discutir as possíveis aproximações entre a Ética da Alteridade e a Justiça Restaurativa. Em termos metodológicos, utiliza-se, fundamentalmente, a pesquisa bibliográfica, complementada pela pesquisa documental. Inicialmente, procede-se a uma revisão da literatura existente sobre o pensamento levinasiano, com destaque para a Ética da Alteridade. Analisa-se a categoria "œRosto do Outro", sustentada por Lévinas, como exigência teórica e ética da Justiça Restaurativa. Delineia-se a convergência de perspectivas e posicionamentos ético-jurídicos entre a Ética da Alteridade e a Justiça Restaurativa. Conclui-se com o reconhecimento de que a Alteridade é fundamento ético da Justiça Restaurativa.

Metodologia: A pesquisa é de natureza teórico-bibliográfica, documental e jurisprudencial seguindo o método indutivo, e seu objetivo metodológico é exploratório e propositivo.

Resultados: O artigo discute a Ética da Alteridade e a Justiça Restaurativa como subsídios para o desenvolvimento de sociedades fraternas, justas, inclusivas e plurais, baseadas na igualdade e no respeito à diferença. Nesse sentido, ficou evidente que os elementos da ética são determinantes para a humanização das relações sociais profundamente desumanizadas por uma ordem social injusta, marcada por discriminações, indiferenças e egoísmos.

Contribuições: Evidenciar a perspectiva da Alteridade como um elemento fundamental ético da Justiça Restaurativa. Nesse processo de aproximações, a Ética da Alteridade e a Justiça Restaurativa sinalizam caminhos fraternos e eticamente responsáveis, capazes de contribuir para o enfrentamento do quadro de violências e apartações que configuram os tempos atuais, na perspectiva de restaurar e dignificar as relações humanas.

ABSTRACT

Objective: This paper, inserted in the scope of the philosophy of Emmanuel Lévinas and the Restorative Paradigm in the sphere of contemporary Criminal Law, seeks to circumscribe and discuss the possible approximations between the Ethics of Alterity and Restorative Justice. In methodological terms, bibliographic research is fundamentally used, complemented by documentary research. Initially, a review of the existing literature on Levinasian thought is carried out, with emphasis on the Ethics of Alterity. The category "œFace of Another," maintained by Lévinas, is analyzed as a theoretical and ethical requirement of Restorative Justice. The convergence of perspectives and ethical-legal positions between the Ethics of Alterity and Restorative Justice is outlined. It concludes with the recognition that Alterity is the ethical foundation of Restorative Justice.

Methodology: The research is of a theoretical-bibliographical, documentary and jurisprudential nature following the inductive method, and its methodological objective is exploratory and propositive.

Results: The article discusses the Ethics of Alterity and Restorative Justice as subsidies for the development of fraternal, just, inclusive and plural societies, based on equality and respect for difference. In this sense, it became evident that the elements of ethics are determinants for the humanization of social relations deeply dehumanized by an unjust social order, marked by discrimination, indifference and selfishness.

Contributions: To emphasize the perspective of Alterity as a fundamental ethical element of Restorative Justice. In this process of rapprochement, the Ethics of Alterity and Restorative Justice signal fraternal and ethically responsible ways, capable of contributing to the confrontation of the picture of violence and appearances that configure the current times, in the perspective of restoring and dignifying human relations.
