O DANO TEMPORAL COMO CATEGORIA DE DANO AUTÔNOMO NA JURISPRUDÊNCIA DO SUPERIOR TRIBUNAL DE JUSTIÇA

Objetivo: revelar o valor do tempo na vida de um indivíduo e demonstrar que, quando desperdiçado por falha  atribuível aos fornecedores de  bens  e  serviços, emerge uma nova categoria de dano, autônoma e indenizável, com respaldo na teoria do desvio produtivo do consumidor.
Metodologia: a pesquisa é  exploratória e de abordagem qualitativa, tendo  o  levantamento  bibliográfico e documental como procedimentos adotados. Examina-se alguns julgados do Superior Tribunal de Justiça acerca do tema que evidenciam a dissonância existente entre as turmas da Corte sobre o conceito e aplicação desta categoria de dano.
Resultados: uma das principais conclusões apresentadas é que, embora robusta a doutrina que conceitua o dano temporal, ainda há bastante divergência sobre a sua definição e a sua aplicação pelo Judiciário, o que exige a sua permanente defesa nas situações jurídicas  subjetivas  em  que  há  a  perda  do  tempo  vital  do  consumidor.
Contribuições: o surgimento de uma nova categoria de dano, além daquelas já expressamente previstas:  o  dano  temporal, o  qual está relacionado  à   teoria  do desvio produtivo do consumidor e possui autonomia em relação ao  dano moral stricto sensu.

ABSTRACT
Objective: to reveal the value of time in an individual's life and demonstrate that,when  wasted  by  failure  attributable  to  suppliers  of  goods  and  services,  a  newcategory  of  damage  emerges,  autonomous  and  indemnifiable,  supported  by  thetheory of productive deviation from consumer.Â
Methodologically: the research isexploratory and with a qualitative approach, with the bibliographic and documentarysurvey as procedures adopted. Some judgments of the Superior Court of Justice areexamined on the subject, which show the dissonance that exists between the classesof the Court on the concept and application of this category of damage.
Results: oneof the main conclusions presented is that, although the doctrine that conceptualizestemporal  damage  is  robust,  there  is  still  considerable  disagreement  about  itsdefinition and application by the Judiciary, which requires its permanent defense insubjective legal situations in which the consumer's vital time is lost.
Contributions:the emergence of a new category of damage, in addition to those already expresslypredicted: temporal damage, which is related to the theory of productive deviation ofthe consumer and has autonomy in relation to stricto sensu moral damage.
