FORUM SHOPPING, FORUM NON CONVENIENS E A MANIPULAÇÃO DA JURISDIÇÃO NAS AÇÕES RELATIVAS AO DIREITO À SAÚDE

Objetivo: Debater licitude do uso do forum shopping enquanto escolha discricionária da jurisdição ou juízo competente pelo autor das demandas sobre efetivação do direito à saúde buscando a sua melhor satisfação individual.
Metodologia: Utilização do modelo dedutivo e da revisão de literatura sobre o tema do forum shopping e forum non conveniens, além da análise da jurisprudência sobre a sua aplicação.
Resultados: Reconhecer que o direito de escolha na judicialização da saúde como lesivo à pacificação dos conflitos, pois produz microjustiças em detrimento do interesse coletivo. Esta escolha produz uma série de inconvenientes e a solução pode passar pelo modelo do forum non conveniens.
Contribuição: Propor o modelo do forum non conveniens como alternativa viável para solução dos conflitos de saúde, notadamente por permitir que o juízo deixe de apreciar determinado conflito por não se reconhecer como o mais adequado para pacificação da demanda.

ABSTRACT
Objective: Debating the legality of forum shopping as a discretionary choice of jurisdiction or competent court by the author of the health demands seeking their best individual satisfaction.
Methodology: Use of the deductive model and literature review of forum shopping and forum non conveniens, in addition to the analysis of jurisprudence on its application.

Results: Recognize that the right to choose the competent jurisdiction or court in the judicialization of health is harmful to the pacification of conflicts, as it produces micro-justices over the collective interest. This choice produces a series of inconveniences and the solution may be through the use of forum non conveniens.
Contribution: Propose the forum non conveniens as a viable alternative for solving health conflicts, notably for allowing the court to decline the appreciation of a certain conflict for not recognizing itself as the most appropriate for pacifying the demand.
