GOVERNANÇA DA PRIVACIDADE E AS ORGANIZAÇÕES SOCIAIS DE SAÚDE: UMA ANÁLISE DA LEI GERAL DE PROTEÇÃO DE DADOS

Objetivo: analisa-se no artigo a gestão das organizações sociais de saúde e a proteção contra irregularidades e violações de direitos por meio da análise Lei Geral de Proteção de Dados.
Metodologia: utiliza-se o método dedutivo, mediante a revisão bibliográfica e documental, por meio da revisão de obras e artigos científicos; bem como a legislação pertinente ao tema.
Resultados: O setor público de saúde mobiliza milhões de pessoas diariamente, sendo imprescindível a proteção de dados que podem promover discriminações ou utilizações inadequadas, haja visto que trata, conforme o Art. 5º., da Lei nº. 13709/2018, sobre origem racial ou étnica, convicção religiosa, opinião política, filiação a sindicato ou a organização de caráter religioso, filosófico ou político, dado referente à saúde ou à vida sexual, dado genético ou biométrico, quando vinculado a uma pessoa natural.
Contribuições: Traz-se ao debate o tema atual da Lei Geral de Proteção de Dados, em razão da sociedade de informação e do uso da internet.

ABSTRACT
Objective: the article proposes to analyze the management of social health organizations and the protection against irregularities and violations of rights through the analysis of the General Data Protection Law.
Methodology: the deductive method is used, through bibliographic and documentary review, by way of reviewing books and scientific articles; as well as the legislation pertinent to the subject.
Results: The public health sector mobilizes millions of people daily, and it is essential to protect data that can promote discrimination or inappropriate uses, provided that it deals, according to Article 5 of Law No. 13709/2018, about racial or ethnic origin, religious conviction, political opinion, membership of a trade union or the organization of a religious, philosophical or political nature, health or sexual life, genetic or biometric data, when linked to a natural person.
Contributions: The current theme of the General Data Protection Law is brought to the debate, due to the information society and the use of the Internet. Â
