CONSTITUIÇÃO E PENSAMENTO POLÍTICO BRASILEIRO: A NECESSIDADE DE UMA TEORIA SOCIAL ATRELADA À TEORIA DA CONSTITUIÇÃO

Resumo

Objetivo: o presente artigo trata de estudo voltado à abordagem do fenômeno constitucional. Objetiva-se, a partir da premissa de ineficácia de normas constitucionais, analisar os caminhos, entre a dogmática constitucional e a ciência política, para a abordagem do problema a fim de compreender tais ineficácias.

Metodologia: utiliza-se o método dedutivo, atrelado a técnicas de pesquisa bibliográfica em teoria constitucional e Ciência Política no modelo de pesquisa jurídico-social. 

Resultados: o trabalho adere, do ponto de vista ontológico, às teorias dialéticas-culturais de Constituição, de modo a compreender a Constituição por uma perspectiva total e não parcial (ou unilateral). Portanto, diante da hibridez do Direito, considerando a sua estreita relação entre o Direito Constitucional e a Ciência Política, conclui-se que o problema de eficácia da Constituição brasileira de 1988 deve ser estudado a partir de uma teoria social brasileira, a considerar o pensamento político brasileiro que permeia as estruturas sociais.

Contribuições: o trabalho busca contribuir ao debate, demonstrar a interdisciplinaridade diante de uma concepção total de Constituição, a fim de descolar a problemática de ineficácia da Constituição da dogmática constitucional a uma Ciência Política propriamente brasileira.

ABSTRACT

Objective: This paper is a study aimed at the approach of the constitutional phenomenon. The objective is, starting from the proposition of inefficacy in constitutional regulations, analyzing the directions between the constitutional dogmatic and the political science to deal with the problem willing to understand the constitutional inefficacies.

Methodology: For this purpose, it is used the deductive method linked to the bibliographical techniques survey in constitutional theory and Political Science, in juridical-social survey model. The research combines, from ontological point of view, the dialectical-cultural theories of Constitution in order to understand the Constitution in a total perspective, and not in partial perspective (or unilateral).

Results: Therefore, facing the hybridity in Law and considering its close relation between Constitution Law and Political Science it is concluded that the problem in effectiveness of Brazilian Constitution from must be study based on a Brazilian social theory, considering the Brazilian political thought that permeates the social structures.

Contributions: the work seeks to contribute to the debate, to demonstrate interdisciplinarity before a total conception of the Constitution, in order to take off the problem of ineffectiveness of the Constitution from constitutional dogmatics to a Properly Brazilian Political Science
