OS TRIBUNAIS DE CONTAS E O COMPLIANCE

Objetivo: demonstrar a importância da atuação dos Tribunais de Contas no controle externo e no combate à corrupção; bem como exaltar a relevância da adoção de Programas de Compliance no âmbito dos Tribunais de Contas.
Metodologia: utiliza-se o método dedutivo, mediante abordagens bibliográfica e documental, por meio da revisão de doutrina e a legislação pertinente ao tema.
Resultados: no âmbito dos Tribunais de Contas estaduais, observa-se que o movimento em favor do compliance caminha a passos lentos. Apesar de serem grandes combatentes da corrupção e estarem constantemente fomentando as boas práticas de integridade em suas atividades educativas e orientativas, não são imunes aos desvios de conduta e atos corruptos de seus membros e servidores. O estabelecimento do compliance nos Tribunais de contas mostra-se necessário para a preservação de sua reputação e principalmente para ser exemplo das boas práticas aos seus jurisdicionados.
Contribuições: a pesquisa traz a divulgação de um tema muito atual, que é o compliance anticorrupção, e o presente artigo tece considerações sobre a sua adoção pelo Tribunal de Contas.

ABSTRACT
Objective: to demonstrate the importance of the actions of the Courts of Accounts in external control and in the fight against corruption; as well as to exalt the relevance of the adoption of Compliance Programs within the Courts of Accounts.
Methodology: the deductive method is used, through bibliographic and documentary approaches, by way of review of doctrine and the legislation pertinent to the theme.
Results: within the scope of the State Courts of Auditors it is observed that the movement in favor of compliance is slow. Despite being major combatants of corruption and are constantly fostering good integrity practices in their educational and guiding activities, they are not immune to the misconduct and corrupt acts of their members and servants. The establishment of compliance in the Courts of Accounts is necessary for the preservation of its reputation and especially to be an example of good practice to its jurisdictions.
Contributions: the research brings the dissemination of a very current theme, which is anti-corruption compliance, and this article presents considerations about its adoption by the Court of Accounts.
