INSTRUMENTOS JURÍDICO-AMBIENTAIS E OS PROCESSOS PARTICIPATIVOS: UMA INVESTIGAÇÃO SOBRE O ACORDO DE ESCAZÚ E O ODS-16 DA AGENDA ONU-2030

Objetivo e Metodologia: investigar, sob uma abordagem exploratória, descritiva e crítica, os alinhamentos, divergências e potenciais contribuições do Acordo de Escazú e do ODS-16 em relação ao arcabouço legal e à governança socioambiental no Brasil. Uma revisão bibliográfica e documental narrativa e não exaustiva fundamenta as bases teóricas e empíricas da pesquisa.
Resultados: evidenciam substancial convergência entre as diretrizes presentes no Acordo de Escazú e do ODS-16, as quais encontram-se refletidas expressivamente no arcabouço legal brasileiro. As limitações então devem-se menos à existência de leis apropriadas e mais ao seu efetivo cumprimento para assegurar informação completa e clara à s instâncias participativas.
Contribuições: Ainda que o Brasil tenha instâncias para a participação social e a decisão coletiva, próprias ao debate dos interessados (em especial na esfera do licenciamento), demanda-se um permanente esforço para que não sejam essas conquistas institucionais. A sua fortificação ainda se faz necessária no sistema da Administração Pública, principalmente no âmbito do poder local. Estas instâncias estão à mercê de retrocessos, como observado com a criação do Decreto nº 9.759/2019 que extinguiu colegiados da administração pública federal, o que deve ser refutado.

ABSTRACT
Objective and Methodology: to investigate, under an exploratory, descriptive and critical approach, the alignment, divergence and potential contribution of the Escazú Agreement and the SDG-16 regarding the legal framework and the social-environmental governance in Brazil. A non-exhaustive literature and documental review supports the theoretical and empirical background of the research.
Results: evidence substantial convergence between the guidelines of the Escazú Agreement and the SDG-16, and these guidelines are expressively represented in the Brazilian legal framework. The limitations are less associated to availability of suitable laws, and more to effective compliance to assure complete and clear information to the participative instances.
Contributions: although Brazil has instances for social participation and collective decision specific to the debate of stakeholders (especially in the sphere of licensing), a permanent effort is demanded so that these are not institutional achievements. Its fortification is still necessary in the public administration system, especially in the context of local power. These instances are at the mercy of setbacks, as observed with the creation of Decree No. 9,759/2019 that extinguished collegiates of the federal public administration, which should be refuted.
