ABANDONO FAMILIAR INVERSO: RESPONSABILIDADE CIVIL DOS FILHOS EM RELAÇÃO AOS PAIS IDOSOS

Objetivos: O presente trabalho tem como objetivo o estudo sobre o abandono afetivo dos idosos pelos seus familiares, especificamente os filhos, na busca de uma melhor compreensão sobre os deveres que imperam em tal relação.
Metodologia: A pesquisa envolve um levantamento jurisprudencial e bibliográfico por meio de livros e artigos de direito e tem um caráter descritivo por demonstrar conceitos referentes ao tema em epígrafe.
Resultados: O trabalho esclarece que a dor e a humilhação pelas causas de abandono ao idoso, como a negação do afeto, do convívio e do próprio alimento, não os comprometem só materialmente, pois a dor reflete-se psicologicamente, agravando as limitações do idoso, não podendo mais estas serem desconsideradas em face de ausência de previsão legal no Estatuto do Idoso. Assim, o resultado da pesquisa aponta para a presença de todos os requisitos legais necessários para que se efetue tanto a responsabilização pelo abandono material, quanto pelo imaterial.
Contribuições: Diante das discussões que cercam o tema, o artigo analisa pontos controvertidos que envolvem a possibilidade de responsabilização dos filhos pelo abandono material e afetivo.

ABSTRACT
Objective: This study aims to analyze the affective abandonment of the elderly by their relatives, especially by their sons and daughters, in the search for a better understanding of the duties that prevail in such relationship.
Methodology: The research involves a jurisprudential and bibliographical survey through books and articles of law and has a descriptive character to demonstrate concepts referring to the subject in the epigraph.
Results: The present study clarifies that pain and humiliation due to the causes of abandonment to the elderly, such as the denial of affection, conviviality and food itself, do not only compromise materially, since the pain is psychologically reflected, aggravating the limitations of the elderly, not And may be disregarded in the absence of legal provisions in the Elderly Statute. Thus, the research results point to the presence of all the legal requirements necessary for both the material and the immaterial to be held accountable.
Contributions: In view of the discussions surrounding the theme, the article analyzes controversial points that involve the possibility of making sons and daughters responsible for material and emotional abandonment.
