A EFETIVIDADE DO SISTEMA INTERNACIONAL DE SOLUÇÃO DE CONTROVÉRSIAS NA CONVENÇÃO DE MONTEGO BAY: PROTEÇÃO INTERNACIONAL DO MEIO AMBIENTE MARINHO

Objetivo: O presente trabalho tem como objetivo verificar a efetividade da jurisdição do Tribunal Internacional do Direito do Mar na proteção do meio ambiente marinho, bem como analisar a normalização internacional que regula o sistema internacional de solução de controvérsias na Convenção de Montego Bay, seus institutos e jurisdição.
Metodologia: Trata-se de pesquisa qualitativa, descritiva e explicativa, com método dedutivo e técnica de pesquisa bibliográfica. A atuação do Tribunal Internacional do Direito do Mar foi analisada sob o ponto de vista da efetividade dos procedimentos processuais dispostos na Convenção das Nações Unidas para o Direito do Mar (CNUDM/Convenção de Montego Bay), bem como em outros mecanismos de solução de controvérsias previstos nessa Convenção.
Resultados: Demonstrou-se a efetividade do procedimento de proteção do meio ambiente marinho no Tribunal Internacional do Direito do mar.
Contribuições: O presente estudo traz como contribuição o tema importante da cooperação internacional, que é essencial para codificar as normas do Direito do mar nos âmbitos nacional e internacional, mas é ainda mais importante para dar à s decisões dos órgãos jurisdicionais a efetividade necessária para que tais normas não fiquem restritas ao papel, mas reflitam-se em resultados reais.

ABSTRACT
Objective: The present work aims to verify the effectiveness of the jurisdiction of the International Tribunal for the Law of the Sea in the protection of the marine environment, as well as analyze the international standardisation that regulates the international dispute settlement system in the Montego Bay Convention, its institutes and jurisdiction.

Methodology: Â It is a qualitative, descriptive and explanatory research, with deductive method and technique of bibliographical research. The work of the International Tribunal for the Law of the Sea has been examined from the point of view of the effectiveness of the procedural procedures established in the United Nations Convention on the Law of the Sea (UNCLOS) as well as in other dispute settlement mechanisms provided for in that Convention.

Results: It is demonstrated the the effectiveness of the procedure for the protection of the marine environment in the International Tribunal for the Law of the Sea has been demonstrated.
Contributions: This study brings as a contribution the important theme of international cooperation, which is essential to codify the norms of the law of the sea at the national and international levels, but is even more important to grant the decisions of the courts the necessary effectiveness so that such norms are not restricted to the role, but are reflected in real results.
