UBIQUIDADE DO TÍTULO EXECUTIVO NA EXECUÇÃO E A INADMISSIBILIDADE DE SUA CRIAÇÃO POR CONVENÇÃO ENTRE AS PARTES

Objetivo: Demonstrar a ubiquidade do título executivo na execução e a inadmissibilidade de sua criação por convenção entre as partes.
Metodologia: Utiliza-se o método dedutivo, com revisão doutrinária como opção metodológica; parte-se do estudo do título executivo, analisando-se a importância da polêmica travada entre Carnelutti e Liebman sobre a acepção de título executivo. Em seguida, estudam-se os elementos intrínsecos e extrínsecos do título executivo, bem como sua eficácia abstrata.
Resultados: Em razão da sua ubiquidade e das graves medidas executivas que o título permite desencadear contra a vontade do devedor, o elenco dos títulos executivos reduz-se aos casos estritamente previstos pela lei, sendo inadmissível a convenção entre as partes para a criação de título executivo.
Contribuições: A contribuição do presente artigo é o debate trazido sobre o tema no Direito comparado.

ABSTRACT
Objective: To demonstrate the ubiquity of the executive title in the execution and the inadmissibility of its creation by convention between the parties.
Methodology: Using the deductive method with doctrinal review as a methodological option, we start from the study of the executive title, analyzing the importance of the controversy between Carnelutti and Liebman about the meaning of executive title. Then, the intrinsic and extrinsic elements of the executive title are studied, as well as its abstract effectiveness.
Results: Due to its ubiquity and the serious executive measures that the title allows to trigger against the will of the debtor, the list of executive titles is reduced to the cases strictly provided for by law, and the agreement between the parties for the creation of enforcement order.
Contributions: The contribution of this article is the debate brought on the subject in comparative law.
