O DIREITO DO TRABALHO PANDÊMICO E A CONSTITUIÇÃO DE PRECEDENTES EM TEMPOS DE CRISE: A EFETIVIDADE JURISDICIONAL À LUZ DA TRANSFORMAÇÃO DIGITAL

RESUMO
Objetivo: o presente artigo objetiva abordar o direito do trabalho pandêmico, consistente no conjunto de enunciados normativos que tratam acerca da matéria laboral na pandemia, em especial as Medidas Provisórias n. 927/2020, n. 936/2020 (Lei n. 14.020/2020) e n. 945/2020 (Lei n. 14.047/2020).
Metodologia: Utiliza-se o método indutivo e o marco teórico será a obra "œOs precedentes e a crise dos direitos fundamentais: a ratio de uma tragédia anunciada" (José Roberto Freire Pimenta e Roberta Ferme Sivolella).
Resultados: O contexto pandêmico exigiu a tomada de medidas de enfrentamento que viabilizassem o isolamento e reduzissem a propagação do vírus, de modo a preservar a vida, a saúde e a segurança da sociedade
Contribuições: o procedimento estabelecido para o processamento e o julgamento das demandas ajuizadas, sobretudo o uso de videoconferência nas sessões de julgamento e audiências, bem como a constituição dos precedentes judiciais em tempos de crise à luz da coisa julgada e da segurança jurídica, que possuem vínculo direto com a autoridade, a observância e os efeitos dos pronunciamentos judiciais, para averiguar os influxos da transformação digital na efetividade jurisdicional.

ABSTRACT
Objective: This article aims to address pandemic labor law, consisting of the set of normative statements that deal with labor matters in the pandemic, in particular Provisional Measures n. 927/2020, no. 936/2020 (Law no. 14.020/2020) and no. 945/2020 (Law No. 14047/2020).
Methodology: The inductive method is used and the theoretical framework will be the work "œThe precedents and the crisis of fundamental rights: the ratio of an announced tragedy" (José Roberto Freire Pimenta and Roberta Ferme Sivolella).
Results: The pandemic context required the taking of measures to combat the isolation and reduce the spread of the virus, in order to preserve the life, health and safety of society.
Contributions: the procedure established for the processing and judgment of claims filed, especially the use of videoconferencing in trial sessions and hearings, as well as the establishment of judicial precedents in times of crisis in the light of res judicata and legal certainty, which have direct link with the authority, compliance and effects of judicial pronouncements, to investigate the influences of digital transformation on jurisdictional effectiveness.
