A INCONSTITUCIONALIDADE DA RELATIVIZAÇÃO DOS DIREITOS FUNDAMENTAIS EM TEMPOS DE PANDEMIA DE COVID-19: UM BREVE ESTUDO DO LOCKDOWN NO ESTADO DO MARANHÃO

Objetivo: O presente estudo tem por objetivo analisar os mecanismos emergenciais adotados no Brasil, destacando os riscos da extrapolação do limite constitucional para a democracia brasileira.
Metodologia: Para tanto, a presente incursão teórica fará a análise documental dos instrumentos nacionais e internacionais de controle da pandemia do COVID-19, com aportes teóricos bibliográficos para fundamentar o estudo de forma crítica e reflexiva.
Resultados: Resta demonstrado que o Brasil adota mecanismos de isolamento social, comercial e empresarial, a partir das recomendações da Organização Mundial de Saúde e do Ministério da Saúde nacional. Dentro deste contexto, impende registrar que a afetação dos direitos fundamentais para combater a pandemia deve seguir os ditames constitucionais.
Contribuições: A principal contribuição desse trabalho é demonstrar a importância do cumprimento do texto constitucional para a aplicação de medidas preventivas durante a pandemia, sob o risco de ameaçar o Estado Democrático de Direito e a Constituição da República de 1988.

 ABSTRACT
Objective: The present study aims to analyze the emergency mechanisms adopted in Brazil, highlighting the risks of extrapolating the constitutional limit to Brazilian democracy.
Methodology: For this purpose, the present theoretical incursion will make a documentary analysis of the national and international instruments for controlling the pandemic of COVID-19, with theoretical bibliographic contributions to support the study in a critical and reflective way.
Results: It remains to be demonstrated that Brazil adopt mechanisms of social, commercial and business isolation, based on the recommendations of the World Health Organization and the national Ministry of Health. Within this context, it is important to note that the allocation of fundamental rights to combat the pandemic must follow constitutional dictates.
Contributions: The main contribution of this work is to demonstrate the importance of complying with the constitutional text for the application of preventive measures during the pandemic, under the risk of threatening the Democratic Rule of Law and the 1988 Constitution itself.
