O GRAVAME LEGAL DA MISTANÁSIA EXACERBADO PELA CRISE PANDÊMICA

Resumo

Contextualização: A crise pandêmica, originada na COVID19, tem quebrado a economia mundial e, no país, causado mortes precoces desnecessárias na sociedade "“ mistanásia, com nexo e implicações legais originados em distintos agentes da estrutura pública.

Objetivo: O objetivo deste artigo é demonstrar as implicações legais concernentes ao Estado, pelo evento da mistanásia de cidadãos, em especial de menor poder aquisitivo, atingidos pelos efeitos da COVID19, com base na privação de seu direito de acesso à saúde, à vida e à sua dignidade.

Método: O presente trabalho, de natureza qualitativa, tem cunho subjetivo e é de ordem teórica.  As premissas, que determinam as relações das implicações legais, são demonstradas por via da interpretação de conceitos, evidências e processos que exacerbam o fenômeno da mistanásia, como uma nefasta consequência social da COVID19.

Resultados: A análise do cenário emergencial causado pela COVID19 aponta para três áreas principais de implicações legais pela exacerbação da mistanásia na sociedade brasileira. Uma delas refere-se ao papel do Estado e a corrupção no sistema público que assola cronicamente a sociedade.  A outra de ordem estrutural, adjunta ao poder judiciário, com interferência sobre a unidade nacional, gerando litigâncias entre agentes públicos para ganhos de poder político. E a terceira, a responsabilidade civil do Estado.

Conclusões: As principais conclusões indicam que em qualquer caso, o Estado, revestido do poder executivo, judiciário e legislativo é, em última análise, o responsável maior pela solapa do direito constitucional à saúde e à vida, do cidadão de menor poder aquisitivo, que o deixam à mercê do evento mistanásia. Demonstra-se com objetividade que a mistanásia, como consequência da COVID 19, é decorrente da inépcia estrutural do Estado que tem obliterado sua culpabilidade constitucionalmente e se auto protegendo de sanções legais pelo descumprimento de suas obrigações constitucionais.

Abstract

 Context: The pandemic crisis caused by COVID-19, introduced a breakdown in the world and Brazilian economies.  It also caused the premature and unnecessary deaths in society, known as mistanásia, with nexus and legal implications bound into distinct agents of the public structure.

 Objective: The aim of this paper is to demonstrate, based on the privation of the access to health, to life and dignity rights, the main legal implications concerning to the State responsibility for the mistanasia among citizens, especially those in the lower social layers, under the effects of COVID-19.

 Method: This work, of a qualitative stamp, has subjective nature, and it is categorized as a theoretical one.  The premises, linking legal implication, are demonstrated by means of conceptual interpretation, evidence and processes that exacerbate the phenomenon of mistanasia, as a malefic social consequence from the spreading of COVID-19.

 Results: The analysis of the emergency scenario caused by COVID-19 points to three main areas of legal implications as a result of the exacerbation of mistanasia in Brazilian society. One refers to the State role and the public system corruption, chronically ravaging the society. The other comes from the structural context, adjunct to the judiciary power, interfering on national unity. It generates litigation among public agents to win political power. And the still another encompasses the State responsibilities.

 Conclusions: Main conclusions indicate that in any case, the State, coated by the executive, judiciary and legislative powers is, ultimately, the main responsible for undermining the constitutional rights of people to health, to life and to human dignity, especially of the citizens with less resources.  This undermining let individuals at the mercy of a growing mistanasia.  It is objectively demonstrated that the exacerbation of mistanasia in society, in times of COVID-19, comes as a result of the structural ineptitude of the State, obliterating its own guiltiness and self-protecting of legal sanctions for not accomplishing its constitutional obligations.
