A CONFUSÃO INTERTEMPORAL ENTRE O NOVO CÓDIGO DE PROCESSO CIVIL E O ESTATUTO DA PESSOA COM DEFICIÊNCIA EM RELAÇÃO À INTERDIÇÃO

Objetivos: O presente artigo tem por objetivo principal a contextualização da confusão gerada com a promulgação do Estatuto da Pessoa com Deficiência, por meio da Lei 13.146/2015, e do Novo Código de Processo Civil, pela publicação da Lei 13.105/2015, no que tange à ação de curatela de interditos.
Metodologia: A pesquisa adota uma abordagem indutiva, fazendo uso dos métodos bibliográfico e estudo de caso, mediante documentação indireta.
Resultados: O artigo infere que houve uma confusão intertemporal entre o Novo Código de Processo Civil e o Estatuto da Pessoa com Deficiência, expõe possíveis desdobramentos e interpretações pertinentes ao tema e propõe uma solução que ampare os impactos que serão sofridos pelos alvos desta disposição legal.
Contribuições: A matéria objeto do presente estudo é motivo de discussões teóricas intermináveis. Por esse motivo, são apresentadas soluções à controvérsia existente, a fim de garantir maior segurança jurídica para ações de curatela de interditos.

ABSTRACT
Objectives: The main objective of this article is to contextualize the confusion generated by the promulgation of the Disabled Person Statute, through Law 13.146 / 2015, and the New Civil Procedure Code, by the publication of Law 13.105 / 2015, regarding regarding the curatorial action of interdicts.
Methodology: The research adopts an inductive approach, making use of bibliographic and case study methods, through indirect documentation.
Results: The article infers that there was an intertemporal confusion between the New Code of Civil Procedure and the Statute of the Person with Disabilities, exposes possible developments and interpretations relevant to the theme and proposes a solution that will cover the impacts that will be suffered by the targets of this legal provision.
Contributions: The subject matter of the present study is the subject of endless theoretical discussions. For this reason, solutions are presented to the existing controversy, in order to ensure greater legal security for actions to curb interdictions.
