A MEMÓRIA COLETIVA COMO DEVER SOCIAL DAS POLÍTICAS DE RESPEITO ÀS DIVERSIDADES EM ÂMBITO PRISIONAL

Objetivo: O artigo estuda o papel da memória como dever social das políticas de respeito à diversidade no sistema prisional brasileiro. Em um primeiro momento, o artigo expõe alguns aspectos sobre a memória como dever social. A seguir, demonstra os caracteres que envolvem a violência institucional e o desrespeito a direitos fundamentais nas prisões, indicando o espaço de violações que afetam as pessoas privadas de liberdade e integrantes dos grupos sociais vulneráveis. Após, exibe uma precisa trajetória histórico-social das violências ocultadas no âmbito do sistema penal brasileiro. Por fim, oferece aproximações entre as políticas de respeito à diversidade e a temática proposta.
Metodologia: O artigo utiliza abordagem dedutiva, revisão bibliográfica e análise de dados e informações. O objetivo metodológico é exploratório e propositivo.
Resultados: Por meio de uma perspectiva crítica da sociologia jurídico-penal e da criminologia, o texto procura indagar em que medida a memória, na sua dimensão coletiva, pode contribuir para a construção de políticas de respeito à s diversidades em âmbito carcerário, e se a recente trajetória das políticas brasileiras sobre o tema se aproxima dessa ideia. As persistentes violações podem ser reavaliadas a partir da atuação da memória coletiva como um dever social das políticas. Ainda, a cultura de resistência deve ser apresentada por meio do respeito à s diversidades e a compreensão das realidades e complexidade acerca da questão criminal e penitenciária.
Contribuições: A pesquisa possui relevância diante da necessária análise das sobrecargas prisionais e das constantes violações dos direitos fundamentais das pessoas integrantes dos grupos sociais vulneráveis/vulnerabilizados. Além disso, fornece importantes questões que se aproximam à psicologia social, pois objetiva a análise da memória e as percepções e racionalidades atinentes ao respeito à diversidade.

ABSTRACT
Objective: This paper studies the role of memory as a social responsibility of policies regarding respect for diversity in the Brazilian prison system. At first, the article exposes some aspects about memory as a social responsibility. It then shows the characteristics of institutional violence and disrespect for fundamental rights in prisons, indicating the scope of violations that affect persons deprived of their liberty and members of vulnerable social groups. Afterwards, it shows an accurate historical-social trajectory of the violence hidden within the scope of the Brazilian penal system. Finally, it offers approximations between the policies of respect for diversity and the proposed theme.
Methodology: The article uses a deductive approach, bibliographic review and analysis of data and information. The methodological objective is exploratory and propositional.
Results: Through a critical perspective of criminal-legal sociology and criminology, the text seeks to explore the extent to which memory, in its collective dimension, can contribute to the construction of policies regarding respect for diversity in prison, and whether the recent trajectory of Brazilian policies on the subject approaches this idea. Persistent violations can be reevaluated based on the performance of collective memory as a social responsibility of policies. Still, the culture of resistance must be presented by respecting diversity and understanding the realities and complexity of the criminal and penitentiary issue.
Contributions: The research has relevance to the necessary analysis of prison overloads and constant violations of the fundamental rights of members of vulnerable social groups. In addition, the text provides some questions about social psychology, because it aims to analyze the memory and the perceptions and rationalities related to respect for diversity.
