OS DESAFIOS GEOGRÁFICOS CONTEMPORÂNEOS DO DIREITO INTERNACIONAL HUMANITÁRIO: INTERPRETAÇÕES E APLICABILIDADE NA ATUAÇÃO DO TPI QUANTO AO AFEGANISTÃO

Resumo

Objetivos: O presente trabalho pretende concluir se a pretensão investigatória da promotoria do TPI quanto às condutas extraterritoriais ao território afegão perpetradas por agentes americanos, no contexto do conflito armado não-internacional no Afeganistão, encontra lastro doutrinário. Objetiva-se, portanto, identificar dentre as atuais doutrinas que versam sobre a aplicabilidade geográfica do Direito Internacional Humanitário uma que se adeque à situação no Afeganistão.

Metodologia: Proceder-se-á uma pesquisa bibliográfica e documental, utilizando o procedimento metodológico dedutivo.

Resultados: O presente artigo propõe que existe lastro teórico para a pretensão da promotoria, calcado na compreensão de os atos que ocorrem no âmbito territorial de um dos Estados beligerantes serão regidos pelo Direito Humanitário, desde que sejam relacionados com as hostilidades. Isso também seria consonante com o princípio da igualdade entre beligerantes que rege os conflitos armados.

Contribuições: A relevância teórica e prática do aspecto geográfico dos conflitos armados não-internacionais não é acompanhada por uma extensa literatura sobre o assunto. Este artigo, portanto, servirá para consolidar estudos em uma área pouco desenvolvida que, paradoxalmente, é essencial para a definição do regime jurídico apropriado a situações extraterritoriais: se é necessário aplicar o Direito Internacional Humanitário ou apenas os Direitos Humanos.

ABSTRACT

Objective: This paper analyses whether the investigation intended by ICC"™s prosecutor concerning the extraterritorial actions to the Afghan territory perpetrated by American agents, in the context of the non-international armed conflict in Afghanistan, has a basis in international law"™s literature. The object is, therefore, to identify among current doctrines which discuss the geographical applicability of International Humanitarian Law one which applies to the situation in Afghanistan.

Methodology: A bibliographical and documental research will be conducted, with deductive methodologic procedure.

Results: This article proposes that there is theoretical support for the prosecution's claim, based on the understanding that the acts that occur in the territorial scope of one of the belligerent states will be governed by Humanitarian Law, as long as they are related to the hostilities. This would also be in line with the principle of equality between belligerents that governs armed conflicts.

Contributions: The theoretical and practical relevance of the geographical aspects of the non-international armed conflicts is not matched by an extensive literature on the matter. This paper, therefore, will serve to consolidate studies on a poorly developed area which is also, paradoxically, essential for the definition of the legal regime appropriate to extraterritorial situations: if one ought to apply International Humanitarian Law or merely Human Rights Law.
