A SUPOSTA ALTERAÇÃO DOS FUNDAMENTOS DO DIREITO ADMINISTRATIVO PELA NOVA REDAÇÃO DA LEI DE INTRODUÇÃO ÀS NORMAS DO DIREITO BRASILEIRO (LINDB)

Resumo

Objetivo: O artigo tem por escopo analisar os impactos da Lei de Introdução às Normas do Direito Brasileiro, atualizada pela Lei 13.655/2018, relativamente aos fundamentos do regime-jurídico administrativo.

Metodologia: O estudo que ora se propõe pretende responder, a partir do método indutivo, o seguinte questionamento: haveria a LINDB alterado os fundamentos do regime jurídico-administrativo?

Resultados: Respondendo à questão central da pesquisa, nota-se que o somatório dos elementos analisados no artigo induzem à conclusão de que a pretensão do legislador com as alterações promovidas pela Lei 13.655/2018, realmente foi a de alterar as bases do Direito Público brasileiro, por intermédio de uma inequívoca visão privatista e neoliberal, que submete o Estado e o interesse coletivo aos anseios particulares, de preservação a qualquer custo dos negócios celebrados com a Administração Pública. Ocorre, que não se pode contrariar a Constituição de 1988 e o regime-jurídico administrativo dela derivado, do que se dessume que as aludidas mudanças no Direito Administrativo Constitucional são apenas aparentes, porquanto a ordinária Lei de Introdução às Normas do Direito Brasileiro, na parte que toca à interpretação do Direito Público, não foi substancialmente produzida em harmonia com o Texto Constitucional.

Contribuições: O estudo, de modo inovador, se afasta da interpretação gramatical da LINDB, especialmente depois de sua reforma pela Lei 13.655/2018, demonstrando a fragilidade e inconsistência de seus fundamentos, muitos dos quais materialmente inconstitucionais.

ABSTRACT

Objective: The article aims to analyze the impacts of the Law of Introduction to the Rules of Brazilian Law, updated by Law 13.655/2018, in relation to the fundamentals of the administrative legal regime.

Methodology: The study herein proposed intends to answer, from the inductive method, the following question: would the Law of Introduction to the Rules of Brazilian Law have changed the foundations of the legal-administrative regime?

Results: Responding to the central question of the research, the sum of the elements analyzed in the article lead to the conclusion that the intention of the legislator with the amendments promoted by Law 13.655/2018 was actually to change the bases of Brazilian Public Law, by intermediation of an unmistakable privatist and neoliberal vision, which submits the State and the collective interest to private desires, to preserve at any cost the business entered into with the Public Administration. The 1988 Constitution and the administrative legal regime derived from it cannot be contradicted, from which it is assumed that the aforementioned changes in the Constitutional Administrative Law are only apparent, since the ordinary Law of Introduction to the Rules of Brazilian Law, in part which concerns the interpretation of Public Law, was not substantially produced in harmony with the Constitutional Text.

Contributions: The study, in an innovative way, moves away from the grammatical interpretation of LINDB, especially after its reform by Law 13.655/2018, demonstrating the fragility and inconsistency of its foundations, many of which are materially unconstitutional.
