A RESPONSABILIDADE DOS FORNECEDORES DE COMBUSTÍVEIS EM CASO DE ADULTERAÇÃO

Objetivo: O artigo tem por escopo analisar a adulteração de combustíveis e, em especial, suas consequências para o consumidor.
Metodologia: A pesquisa realizada é bibliográfica e documental com adoção do método dedutivo no trabalho, partindo-se de uma premissa maior, isto é, a adulteração de combustíveis representa uma grave distorção no mercado de distribuição e comercialização de derivados de petróleo, para se chegar a uma premissa menor, os danos ao consumidor decorrentes da prática ilegal e ilícita.
Resultados: Constatou-se que a tutela dos direitos dos consumidores, indiscutivelmente, passa pelo papel regulatório da ANP, seja com a obrigatoriedade dos revendedores em fornecer testes de aferição da qualidade dos combustíveis ou de explicitar informações relevantes; e se encerra no reconhecimento do direito à reparação de danos pelo poder judiciário. Funda-se, portanto, no binômio prevenção e reparação/punição onde, respectivamente, a ANP e o poder judiciário são os principais expoentes. Em se tratando da reparação dos danos causados por eventuais inconformidades, papel igualmente especial e tema desta pesquisa, a competência é do poder judiciário, com a aplicação da legislação civilista e do Código de Defesa do Consumidor.Â
Contribuições: O estudo divulga um tema importante para a sociedade, qual seja, a análise da alteração de combustível e as sanções cabíveis aos responsáveis.

ABSTRACT
Objective: The article aims to analyze a fuel adulteration and, in particular, the consequences for the consumer.
Methodology: The research carried out is bibliographical and documentary with the adoption of the deductive method, starting from a larger premise, that is, the adulteration of fuels represents a serious distortion in the market for the distribution and sale of petroleum products, to achieve a minor premise, the damages to the consumer arising from the illegal and unlawful practice.
Results: The protection of consumer rights, indisputably, goes through the regulatory role of ANP, whether with the obligation of resellers to provide tests to measure the quality of programs or to specify relevant information; and it ends with the recognition of the right to compensation for damages by the judiciary. It is based, therefore, on the binomial prevention and rejection / punishment where, respectively, the ANP and the judiciary are the main exponents. When it comes to compensation for damage caused by nonconformities, an equally special role and theme of this research, the jurisdiction lies with the judiciary, with the application of civil law and the Consumer Defense Code.
Contributions: The study disclosed an important topic for society, namely, an analysis of the change in fuel and the sanctions applicable to those responsible.
