ERRO ODONTOLÓGICO: DECISÕES DO TRIBUNAL DE JUSTIÇA DE SÃO PAULO

Objetivo: O objetivo deste estudo foi analisar os julgamentos por erro odontológico do Tribunal de Justiça do Estado de São Paulo, Brasil, em um período de doze meses, a fim de obter dados sobre o perfil dos profissionais envolvidos, o tipo de atos ilícitos praticados, as especialidades odontológicas envolvidas, as indenizações concedidas e os tipos de danos. Também teve como objetivo compreender os principais motivos pelos quais os pacientes processaram os profissionais da odontologia.
Metodologia:Â As decisões foram obtidas no site oficial do Tribunal de Justiça do Estado de São Paulo: www.tjsp.jus.br, utilizando descritor "œerro odontológico", período 01/06/2017 a 31/05/2018, na classe "œapelação cível", sendo selecionadas decisões em que o cirurgião-dentista foi condenado em segunda instância.
Resultados: Foram encontrados 267 julgamentos, sendo que 132 tratavam de erro odontológico e em 55 houve condenação. As especialidades mais envolvidas foram implantodontia, prótese dentária e endodontia, o tipo de réu foi pessoa física do sexo feminino, e os elementos de configuração de culpa foram imprudência e negligência. Foi mais frequente obrigação de resultado em implantodontia, prótese dentária e endodontia; as condenações mais aplicadas foram referentes a danos morais e morais/materiais. A maior parte das condenações envolveu penas pecuniárias.
Contribuições: Os dados encontrados na presente pesquisa são importante contribuição na seara da responsabilidade civil em Odontologia. Entender a jurisprudência e conhecer os motivos que levam os pacientes a impetrar processos judiciais contra profissionais da área odontológica pode ajudar a prevenir tais demandas.

ABSTRACT
Objective: The objective of this study was to analyze the judgments on dental malpractice of the Court of Justice of the State of São Paulo, Brazil, in a period of twelve months, in order to obtain data about the profile of the professionals involved, the type of illicit acts performed, the dental specialties involved, the awarded compensation and the types of damage. It also had the objective of understanding the main reasons why patients sued dental professionals.
Methodology: The decisions were retrieved on the official website of the Court of Justice of the State of São Paulo: www.tjsp.jus.br, using the descriptor "œdental error", from 06/01/2017 to 05/31/2018, in the class "œcivil appeal", being selected decisions in which the dentist was convicted in the second instance.
Results: Two hundred sixty seven judgments were found, of which 132 dealt with dental error, and in 55 there was condemnation. The most involved specialties were implantology, prosthodontics and endodontics, the type of defendant was physical (natural) persons and females, and the elements of guilt configuration were imprudence and negligence. Obligation of result was more frequent in implantology, prosthodontics and endodontics; the most applied convictions were for moral and moral/material damages. Most convictions involved monetary penalties.
Contributions: The data found in this research are an important contribution in the field of civil liability in Dentistry. Understanding the jurisprudence and knowing the reasons that lead patients to file lawsuits against dental professionals can help to prevent such claims.
