O IMPACTO DO REGIME JURÍDICO DA TROCA DE INFORMAÇÕES FISCAIS NA UNIÃO EUROPEIA: O CASO PORTUGUÊS

Objetivo: o presente artigo tem por objetivo revelar e clarificar as formas e os mecanismos de troca de informações no domínio da fiscalidade, ao nível da União Europeia e de Portugal, bem como medidas adotadas para a sua implementação, visando o combate à fraude e evasão fiscais. Pretende-se ainda identificar os vários instrumentos legais que têm vindo a ser instituídos para a sua implementação, aplicação e efetivação.
Metodologia: metodologicamente foi adotada a pesquisa de cunho bibliográfico, centrada na análise dos vários instrumentos jurídicos previstos para os Estados-Membros da União Europeia e respetiva transposição para o ordenamento jurídico português que regulamentam a matéria da troca de informações, nomeadamente a troca automática de informações obrigatórias fiscais.
Resultados: os resultados apontaram que Portugal procedeu à transposição das Diretivas da União Europeia e que o sistema de troca de informações fiscais foi bem implementado em Portugal, no entanto necessitando de ser progressivamente aperfeiçoado.
Contribuições: o presente artigo pretende contribuir para o estudo da temática da troca de informações fiscais como um dos principais instrumentos de combate ao planeamento fiscal agressivo, à fraude, elisão e evasão fiscais transfronteiriças, através da análise da evolução dos diferentes instrumentos para o seu combate, configurado nas alterações à s diretivas comunitárias.Â

ABSTRACT
Objective: this article aims to reveal and clarify how ways and mechanisms of exchanging information in the field of taxation, at the level of the European Union and Portugal, as well as measures adopted for its advancement, the fight against fraud and tax evasion. It is also intended to identify the various legal instruments that have been instituted for its implementation, application and enforcement.
Methodology: methodologically, bibliographic research was adopted, centered on the analysis of the various legal instruments distributed to the Member States of the European Union and their respective transposition to the Portuguese legal system that regulates the subject of information exchange, namely the automatic exchange of mandatory tax information.
Results: the results showed that Portugal transposed the European Union Directives ans that the tax information exchange system was well implemented in Portugal, however it needs to be progressively improved.
Contribution: this article aims to contribute to the study of the subject of exchanging tax information as one of the main instruments to combat aggressive tax, fraud, avoidance and administrative tax evasion, through the analysis of the evolution of different instruments to combat it, configured in changes to community directives.
