ESTADO DE DIREITO AMBIENTAL: EVOLUÇÃO E DESAFIOS CONTEMPORÂNEOS

Objetivo:Â Este trabalho busca, com foco na atividade antrópica sobre o meio ambiente, e suas perspectivas político-jurídicas, situar a discussão sobre a crise da modernidade expressa através de questões sociais globais acerca da "œsociedade de risco", discutindo a repercussão das mudanças ambientais que demonstram profundas consequências na dinâmica global dos processos político-econômicos e especialmente sobre a atuação do Estado através da consequente (e necessária) reformulação de suas teses jurídicas, em uma tendência mundial de inclusão dos direitos de proteção ambiental como objetivos dos Estados Constitucionais. O Estado de Direito Ambiental é, pois, um aperfeiçoamento das noções clássicas do "œEstado de Direito", não se traduzindo em superá-lo, mas ampliá-lo ao incorporar o "œambiente saudável" em seus objetivos e paradigmas de funcionamento e cumprimento.Â
Metodologia:Â Este estudo visa percorrer a problemática ambiental por meio da técnica de pesquisa exploratória, concentrando-se na pesquisa bibliográfica, com a verificação e o aprofundamento das doutrinas relacionadas ao assunto.
Resultados: 1) O cenário de mudanças que se apresenta (Holoceno-Antropoceno no cenário de incertezas) deve ter como fim promover a justiça ambiental e o desenvolvimento sustentável com foco nos princípios da precaução e da prevenção; 2) O Estado Democrático visa concretizar direitos fundamentais tutelados, ao mesmo tempo em que busca restaurar direitos fundamentais violados em escala de tempo intergeracional; 3) Constata-se a existência de fortes lacunas na implementação legislativa concernente à temática ao compreender o elemento humano como fator fundamental que dirige e implementa o processo de mudança; 4) Verifica-se a formação de uma nova cidadania, que compreende a dinâmica e os impactos da crise ambiental, e exige-se a busca da qualidade de vida, a partir da adoção de políticas públicas de caráter ambiental; 5) Por fim, observam-se questões controversas acerca do direito coletivo.Â
Contribuições: O presente estudo aborda temática eminentemente atual e relevante nas discussões doutrinárias que é a consequente remodelação das bases estruturais da Ciência Jurídica que, ao incorporar elementos de limitação das liberdades frente aos bens ecológicos, traz conceitos inovadores aos institutos clássicos, com o fortalecimento da sociedade civil e proposta de construção de um novo paradigma de desenvolvimento, fundado no princípio da sustentabilidade, de forma a construir alternativas à crise ambiental em curso, preservando as conquistas experienciadas em momentos anteriores e aprofundando-as para incorporar novos direitos fundamentais.Â

ABSTRACT
Objective: This work seeks, focusing on anthropic activity on the environment, and its political-legal perspectives, to situate the discussion on the crisis of modernity expressed through global social questions about the "œrisk society", discussing the repercussion of environmental changes that demonstrate profound consequences on the global dynamics of political-economic processes and especially on the performance of the State through the consequent (and necessary) reformulation of its legal theses, in a worldwide trend of including environmental protection rights as objectives of Constitutional States. The Environmental Rule of Law is therefore an improvement of the classic notions of the "Rule of Law", not meaning overcoming it, but expanding it by incorporating the "healthy environment" in its objectives and paradigms of operation and compliance.
Methodology: This study aims to cover the environmental issue through the technique of exploratory research, focusing on bibliographic research, with the verification and deepening of the doctrines related to the subject.
Results: 1) The changing scenario that is presented (Holocene-Anthropocene in the scenario of uncertainty) should aim to promote environmental justice and sustainable development with a focus on the principles of precaution and prevention; 2) The Democratic State aims to materialize protected fundamental rights, while seeking to restore fundamental rights violated on an intergenerational time scale; 3) There are strong gaps in the legislative implementation regarding the theme when understanding the human element as a fundamental factor that directs and implements the change process; 4) We observe the formation of a new citizenship, which understands the dynamics and impacts of the environmental crisis, and the search for quality of life is required, based on the adoption of public policies of an environmental nature; 5) Finally, there are controversial issues about collective law.
Contributions: The present study addresses an eminently current and relevant theme in doctrinal discussions, which is the consequent remodeling of the structural bases of Legal Science, which, by incorporating elements of limitation of liberties in relation to ecological goods, brings innovative concepts to classic institutes, with the strengthening of civil society and proposal to build a new development paradigm, based on the principle of sustainability, in order to build alternatives to the ongoing environmental crisis, preserving the achievements experienced in previous moments and deepening them to incorporate new fundamental rights.
