A PROTEÇÃO AMBIENTAL RURAL COMO DIREITO À INFORMAÇÃO E O SIGILO DE DADOS

A Lei Federal n° 12.651/2012, novo Código Florestal, trouxe relevantes alterações ao sistema de proteção ambiental, inclusive com a criação de novos instrumentos de gestão, como o Cadastro Ambiental Rural "“ CAR, que é o registro público eletrônico de âmbito nacional, obrigatório para todos os imóveis rurais, com a finalidade de integrar as informações ambientais das propriedades e posses rurais. O artigo identifica a origem do Cadastro Ambiental Rural e investiga qual a relação jurídica entre o Cadastro Ambiental Rural e o direito à informação, especialmente diante da recente regulamentação do tema por meio da Instrução Normativa 03 do Ministério do Meio Ambiente, de 18 de dezembro de 2014 e seu impacto na região Amazônica, que possui um dos maiores índices de desmatamento e indefinição fundiária do País. A referida instrução normativa determina o sigilo de dados dos titulares de imóveis, constantes do Cadastro Ambiental Rural pessoaispara garantia dos interesses patrimoniais, mas deve ser analisada o possível prejuízo ao direito de informação pelos titulares do direito ao meio ambiente ecologicamente equilibrado.

ABSTRACT

The Federal Law n°. 12.651 / 2012, new Forest Code , brought significant changes to the environmental protection system , including the creation of new management tools , such as the Rural Environmental Registry - CAR , which is the electronic public record nationwide, mandatory for all rural properties , in order to integrate environmental information from rural properties and possessions. The article identifies the origin of the Rural Environmental Registry and investigates what the legal relationship between the Rural Environmental Registry and the right to information, especially given the recent subject of regulation by means of Instruction 03 of Ministry of the Environment, of December 18, 2014 and its impact in the Amazon region, which has one of the highest rates of deforestation and land blurring of the country.Such normative instruction determines the secrecy properties of the data subjects listed in the Rural Environmental Registry for personal guarantee of property interests , but should be considered the possible prejudice to the right to information by the holders of the right to an ecologically balanced environment.
