POLÍTICAS DE AÇÃO AFIRMATIVA NO CONTEXTO DO DIREITO CONSTITUCIONAL BRASILEIRO

RESUMO
O artigo propõe-se a estudar o tema das ações afirmativas, categoria surgida no direito norte-americano na década de 1960, visando a compreendê-la a partir das fontes do direito, da teoria dos sistemas e do modelo de Estado Social e Democrático de Direito, comprometido com a realização de políticas públicas destinadas a superar desigualdades sociais. A partir desse contexto, analisa-se as ações afirmativas em face da Constituição de 1988, avaliando a compatibilidade dessas ações com os princípios da igualdade e da dignidade da pessoa humana, para afirmar a sua constitucionalidade em face da Carta Maior. Por derradeiro, demonstra-se a necessidade de sua implementação como política de Estado no Brasil, destinada à superação das diversas formas de preconceito.

ABSTRACT
The article intends to study the theme of affirmative actions, an institute originated within the North America Law in the decade of 1960, aiming to comprehend it by studying the sources of law, the Systems"™ theory, the models of Welfare State and Legal State, committed to accomplish the public policy headed to eliminate wealth and income differences. Thus, the affirmative actions will be analysed in the presence of Constitution of 1988, measuring the compatibility of these actions with the law principles of Isonomy and Dignity, to affirm its judicial review in the presence of the Constitution of 1988. Finally, it will demonstrate the needs of using affirmative actions as a state policy in Brazil, headed to eliminate several types of prejudice.
