Perspectivas de transformação do ensino jurídico: a postura reflexiva e crítica na pedagogia progressista

RESUMO

Neste trabalho pretende-se identificar no ensino jurídico uma via a partir da qual pode-se pensar em sua articulação com mudanças sociais, em especial no âmbito jurídico. Para tanto, é evidenciado como necessário o desenvolvimento de uma postura reflexiva e de uma visão crítica na formação acadêmica; fatores que, conforme previsão na Resolução CNE/CES n° 9, devem ser assegurados ao graduando em direito. Buscando encontrar perspectivas para a eficácia dessa Resolução, esta pesquisa investiga, sob a óptica da abordagem pedagógica progressista, questões concernentes ao Projeto Pedagógico do curso de graduação em Direito, apontando para a integração entre teoria e prática através da interdisciplinaridade, perseguindo uma compreensão mais ampla do Direito e uma formação mais apurada dos juristas.

ABSTRACT

This work aims to Identify in law"™s teaching a way from which social change can emerge, especially in the legal framework. For this, it is demonstrated how necessary is the development of reflexive and critical points of view. This attitude, as provided in Resolution CNE/CES n ° 9, ought to be secured to the students by law schools. Seeking to find perspectives for the efficacy of such Resolution, this research investigates, from the progressive pedagogical approach, questions concerning Educacional Project of undergraduate course of law. Indicating for either the integration of theory and practice and the interdisciplinarity, the focus is on a more comprehensive understanding of law and a more wide formation of jurists.
