O COMPLIANCE NA NOVA LEI DE LICITAÇÕES E AS REGRAS DE DIREITO INTERNACIONAL APLICÁVEIS: DO PACTO GLOBAL À LICITAÇÃO VERDE

Resumo

RESUMO: A implementação de programas de integridade no âmbito empresarial, especialmente quando há expressiva interação entre a iniciativa privada e poder público por meio dos processos licitatórios, tem representado importante avanço no combate à malversação do erário, obstando a reiteração de atos de improbidade por agentes públicos e sociedade em geral. Em virtude do contexto pandêmico deflagrado mundialmente em meados de 2020, foi necessário conferir maior celeridade e dinamismo aos processos de contratações estatais, de modo que o Poder Legislativo editou a chamada Nova Lei de Licitações, com o intuito de retificar contradições normativas, modernizar o processo licitatório e fomentar a prática do compliance corporativo. No entanto, longe de ser uma iniciativa exclusivamente nacional, a chamada Era da Integridade apresenta diversos instrumentos jurídicos presentes em diversos tratados internacionais, também vigentes e ratificados aqui no Brasil.  Assim, na presente análise, fazendo uso do método dedutivo, por meio da pesquisa bibliográfica de caráter exploratório, far-se-á uma perquirição das relevantes inovações legais atinentes ao novo diplomado normativo à luz de importantes princípios de matriz constitucional, traçando-se um paralelo entre acordos internacionais dos quais o Brasil é signatário.

ABSTRACT: The implementation of integrity programs in the business sphere, especially when there is significant interaction between the private sector and the Public Power through the bidding processes, has represented an important advance in the fight against embezzlement of the treasury, preventing the reiteration of acts of improbity by agents public and society in general. Due to the pandemic context that broke out worldwide in mid-2020, it was necessary to provide greater speed and dynamism in the processes of state contracting, so that the Legislative Power edited the so-called New Bidding Law, in order to rectify normative contradictions, modernize the process bidding process and encourage the practice of corporate compliance. However, far from being an exclusively national initiative, the so-called Era of Integrity presents several legal instruments present in several international treaties, also in force and ratified here in Brazil. Thus, in the present analysis, making use of the deductive method, through bibliographic research of an exploratory nature, an investigation will be made of the relevant legal innovations concerning the new normative diploma in the light of important principles of the constitutional matrix, tracing a parallel between international agreements to which Brazil is a signatory.
