GREENING: O ESVERDEAMENTO DOS DIREITOS HUMANOS E O PROTAGONISMO DA CORTE INTERAMERICANA DE DIREITOS HUMANOS

A crise ecológica que atingiu o sistema Terra decorrente da globalização e do capitalismo ressaltou a discussão a respeito do antropoceno, enquanto posicionamento filosófico, a fim de contextualizar o papel do ser humano diante da relação humanidade-meio ambiente. Por essa razão, o trabalho tem o objetivo geral de analisar o movimento denominado greening para a proteção ao meio ambiente sob o olhar dos direitos humanos e a partir da jurisprudência da Corte Interamericana de Direitos Humanos, precisamente com o estudo de dois precedentes, o Parecer Consultivo 23/2017 e a sentença do Caso Nuestra Tierra, a fim de demonstrar que a contribuição dos tribunais internacionais é imprescindível para a concretização dos direitos humanos. O artigo tem o objetivo específico de analisar a intrínseca relação entre direitos humanos e meio ambiente através do método dedutivo, utilizando-se os precedentes judiciais mencionados para se chegar à conclusão de que a comunidade internacional da nova ordem global tem a responsabilidade intergeracional de zelar pela proteção ao meio ambiente enquanto direito humano fundamental. O trabalho também abordará a ideia de que a crise ecológica decorre do antropoceno e que existe a necessidade de se humanizar essa vertente da evolução do sistema Terra, além de defender a harmonização entre o antropocentrismo e o ecocentrismo no sentido de proporcionar o desenvolvimento sustentável.

ABSTRACT

The ecological crisis that has affected the Earth system as a result of globalization and capitalism has made viable the discussion about the Anthropocene, as a philosophical position in order to discuss what is the role of human beings in the relationship between humanity and the environment. For this reason, the paper has the general objective of analyzing the movement called greening for the protection of the environment from the jurisprudence of the Inter-American Court of Human Rights, precisely with the study of two precedents, the Advisory Opinion 23/2017 and the judgment of the Nuestra Tierra Case, in order to demonstrate that the contribution of international courts is indispensable for the realization of human rights. The article has the specific objective of analyzing the intrinsic relationship between human rights and the environment through the deductive method, using the mentioned judicial precedents to reach the conclusion that the international society of the global order has an intergenerational responsibility to ensure the protection of the environment as a fundamental human right. The paper will also address the idea that the ecological crisis stems from the Anthropocene and that there is a need to humanize this aspect of the evolution of the Earth system, in addition to advocating the harmonization between anthropocentrism and ecocentrism in order to provide sustainable development.
